Welcome to Mercy Psychiatry & Wellness (“Mercy Psychiatry & Wellness,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, online features, and any related communications (collectively, the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms are intended to support a safe, respectful, and lawful experience for all users.


1) Not Medical Advice / No Provider–Patient Relationship Through the Site

The Site provides general information and administrative tools (such as contact or scheduling links). The Site is not a substitute for professional medical advice, diagnosis, or treatment.

Using the Site does not create a provider–patient relationship. A provider–patient relationship is established only after appropriate intake steps are completed, you are accepted as a patient (if applicable), and you receive confirmation of care.

Do not use the Site for emergencies. If you are experiencing a medical or mental health emergency, call 911 or go to the nearest emergency room. You may also call or text 988 (U.S. Suicide & Crisis Lifeline) for 24/7 support.


2) Eligibility

You must be at least 18 years old to use the Site on your own behalf. If you are using the Site for another person (such as a dependent), you represent that you have legal authority to do so.


3) Appointments, Telehealth, and In-Person Services

Mercy Psychiatry & Wellness offers telehealth and in-person appointments.

When you request an appointment, you agree that:

  • Appointment availability is not guaranteed.
  • You will provide accurate contact and scheduling information.
  • You will follow instructions provided for telehealth visits (technology, identity verification, and any required forms).

Telehealth may not be appropriate for every clinical situation. We may recommend in-person care or another level of support when clinically appropriate.


4) Scheduling Platforms and Third-Party Services

Our Site may link to third-party services (e.g., scheduling, telehealth, insurance verification platforms). These services are operated by third parties and may have their own terms and privacy policies. We do not control third-party sites and are not responsible for their content, availability, or practices.

Your use of third-party services is at your own discretion and subject to their terms.


5) Acceptable Use

You agree not to use the Site in any way that is unlawful, harmful, or disruptive. This includes, without limitation:

  • Attempting to gain unauthorized access to systems or accounts
  • Uploading or transmitting malware, harmful code, or spam
  • Harassing, threatening, or abusing others
  • Submitting false information, impersonating others, or misrepresenting your identity
  • Interfering with the Site’s functionality or security

We may restrict or block access to the Site if we believe you have violated these Terms.


6) User Submissions (Contact Forms and Messages)

If you submit information through forms or email, you agree that:

  • The information you provide is accurate and current to the best of your knowledge
  • You will not submit content that is unlawful, threatening, defamatory, obscene, or infringing

Do not submit highly sensitive clinical details through general contact forms unless specifically requested. For established patients, we may provide alternative secure communication options.


7) Intellectual Property

All content on the Site—such as text, logos, branding, design elements, and graphics—is owned by or licensed to Mercy Psychiatry & Wellness and protected by applicable intellectual property laws.

You may view, print, or download limited portions of the Site for personal, non-commercial use only. You may not copy, modify, distribute, publicly display, or create derivative works from the Site content without our written permission.


8) No Guarantees; Site Provided “As Is”

The Site is provided on an “as is” and “as available” basis. We do not guarantee that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

We may change, suspend, or discontinue any part of the Site at any time without notice.


9) Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that information on the Site is complete, accurate, or current at all times.


10) Limitation of Liability

To the fullest extent permitted by law, Mercy Psychiatry & Wellness and its owners, clinicians, staff, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of (or inability to use) the Site.

If liability is found, our total liability for any claim related to the Site will not exceed $100 (or the minimum amount allowed by law if this limit is not permitted).

Some states do not allow certain limitations, so parts of this section may not apply to you.


11) Indemnification

You agree to defend, indemnify, and hold harmless Mercy Psychiatry & Wellness and its affiliates, clinicians, staff, and representatives from any claims, damages, liabilities, losses, and expenses (including attorneys’ fees) arising from:

  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any law or third-party rights

12) Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use information. By using the Site, you agree to the Privacy Policy.


13) Communications and Consent

By contacting us through the Site or providing your phone number/email, you consent to receive communications related to your inquiry, scheduling, or services. Standard message and data rates may apply if texting is used.

We do not guarantee immediate response times. The Site and contact channels are not intended for urgent or emergency communications.


14) Geographic Scope and Licensure

Our services are based in Murrieta, California. Clinical services may be limited by provider licensure rules and telehealth regulations. We reserve the right to decline or limit services if you are located in a jurisdiction where we are not authorized to provide care.


15) Termination

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms or used the Site improperly. Termination does not affect any rights or obligations that should survive (including intellectual property, disclaimers, and limitations of liability).


16) Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

You agree that any dispute arising from these Terms or your use of the Site will be brought in state or federal courts located in or serving Riverside County, California, unless otherwise required by law.


17) Changes to These Terms

We may update these Terms at any time. Updates will be posted on this page with a revised Effective Date. Your continued use of the Site after changes are posted means you accept the updated Terms.
